Ben Lusty’s practice focuses primarily on three areas: 1) defending healthcare practitioners such as surgeons, physicians, nurses, therapists, and facilities against malpractice claims 2) advising insurance companies as to whether claims and losses are covered, including representing parties in declaratory judgment actions to determine insurance coverage; and 3) representing parties in appellate litigation before federal appellate courts and Utah appellate courts. In addition to these areas, Ben also represents parties in general civil litigation, and assists businesses and non-profits in their business transactions. Ben is an experienced trial attorney and litigator, and regularly obtains pre-trial dismissals of his clients from high-risk lawsuits, or highly favorable settlements, made possible by successful litigation strategy.   

 Ben is admitted to practice law in Utah, the United States District Court for the District of Utah, and the United States Court of Appeal for the 10th Circuit. He obtained his Juris Doctor from William and Mary School of Law in 2008, graduating in the top ten percent of his class and obtaining election to the Order of the Coif. He obtained a Bachelor of Arts, magna cum laude, from the University of Utah in 2005. He recently completed a Master of Business Administration from Imperial College London, with merit in 2017.
